Personal Injury law, known as tort law, is meant to protect you against the negligent actions of others. An injured party (plaintiff) who files a lawsuit must show that the wrongdoer (defendant) owed the plaintiff “a duty of care” and that he failed to exercise reasonable care when performing that duty. For instance, a driver has a duty to others on the road to drive in a safe manner and to obey all traffic laws. If he breaches that duty by driving erratically and colliding into another vehicle, he can be held liable for injuries and damages to the other driver.
Similarly, a physician must use a professional standard of care when treating his patients. The doctor can be held liable if he violated his duty and caused injuries and damages due to his negligence or substandard medical care.
Although car accidents are the most common form of personal injury claim, there are many types of injury claims, including those that occur on the premises of businesses or property owners (Premise Liability). When a person trips in an uneven surface and breaks his leg in a convenience store, he may sue the owner because the owner allowed the dangerous condition to exist.
Other injuries occur from defective toys, medical devices, industrial equipment or pharmaceuticals. A consumer may file a Product Liability suit against a manufacturer for his injuries if the product was designed or manufactured in a dangerous or defective manner, or if the manufacturer failed to warn the consumer of potential risks.
